Friction as a Feature: How Legal Frameworks Reshape Markets

For years, the country operated under a patchwork of state-level rules that created more confusion than protection. Businesses struggled to know what they were permitted to do. It relocates it, usually somewhere less observable. The evolution of gambling laws in Germany over the 2018–2024 period illustrates this with unusual clarity: the shift from the First Interstate Treaty to the Fourth, culminating in a federal licensing system under the Glücksspielbehörde, was explicitly framed as a harm-reduction measure. The logic was straightforward — bring activity onshore, make it visible, attach conditions to it. Some were faster — Sweden's re-regulation in 2019 preceded Germany's federal licensing framework — others slower, and a few remain in earlier stages of the same process. It moves quickly, it operates internationally by default, and its consumer base is distributed and largely anonymous. If you can build a licensing system that works for it, you've solved a version of the problem that applies to most of the digital economy.

The cultural dimension is worth holding onto, though.

European attitudes toward gambling vary in ways that don't map neatly onto north-south or east-west divides. Italy has one of the most developed licensing frameworks on the continent and one of the highest rates of problem gambling. The Netherlands introduced strict advertising bans alongside its re-regulation in 2021. Germany's framework sits somewhere in between — more permissive than the Dutch model on marketing, more restrictive than the Italian one on product types. None of these approaches is obviously correct. They reflect different political settlements and different assumptions about state paternalism versus individual autonomy, questions that recur across health policy, urban planning, and labor law with the same absence of clean answers.
