Environmental Risk Assessment (ERA) Services in Europe: Supporting Pharmaceutical Companies with Regulatory Compliance

For pharmaceutical companies seeking marketing authorization in Europe, proving safety and efficacy is only part of the equation. Today, every submission to the European Medicines Agency (EMA) or national competent authorities must also demonstrate that the medicinal product does not pose an unacceptable environmental risk.

What was once viewed as a secondary regulatory checkbox has evolved into a rigorous, scientifically complex component of the dossier. Inadequate planning or delayed assessments can lead to severe consequences, including unexpected clock-stop inquiries, regulatory pushback, or unnecessary post-authorisation commitments.

The Regulatory Basis for ERA in Europe

Environmental risk assessments for human medicinal products in the EU are governed primarily by the EMA’s Guideline on Environmental Risk Assessment of Medicinal Products for Human Use and Directive 2001/83/EC, while veterinary products follow Regulation (EU) 2019/6. Furthermore, if an active substance involves exposure pathways to surface and groundwater or requires REACH registration, sponsors must meticulously align their ERA data requirements with the EU Water Framework Directive and REACH obligations.

Crucially, unlike safety and efficacy modules, an unfavorable environmental profile alone is rarely grounds for refusing a marketing authorization. However, competent authorities routinely enforce stringent risk mitigation measures, mandatory product labeling requirements, and long-term environmental monitoring commitments based on ERA outcomes. Incomplete or poorly justified dossiers almost invariably trigger review delays.

The Two-Phase Structure of a European ERA

The EMA framework evaluates environmental risk through a structured, sequential two-phase approach:

  1. Phase I: Estimating Environmental Exposure Phase I calculates the Predicted Environmental Concentration in surface water (PECsw) using parameters such as maximum daily doses, market penetration factors, and standard dilution assumptions. If the resulting PECsw falls below the established action limit—and the substance is not flagged as a persistent, bioaccumulative, or toxic (PBT) compound or a known endocrine disruptor—no further testing is required.

  2. Phase II: Fate, Effects, and Risk Characterization When Phase I exposure estimates surpass the action limit, sponsors must advance to Phase II, which is divided into distinct tiers:

    • Tier A: Focuses on physicochemical properties, environmental fate (including biodegradation, hydrolysis, and adsorption), and initial ecotoxicological evaluations across aquatic and relevant terrestrial compartments.

    • Tier B: Required if Tier A outcomes demand deeper investigation. This phase involves comprehensive chronic toxicity studies and complex assessments of sediment and soil compartments, heavily aligned with REACH methodologies for PBT/vPvB screening.

Common Pitfalls in ERA Planning and Execution

Despite the clear framework, pharmaceutical sponsors frequently stumble during ERA preparation due to several recurring hurdles:

  • Late-Stage Initiation: Deferring Phase II ecotoxicology studies until the clinical and Chemistry, Manufacturing, and Controls (CMC) dossiers are nearly complete often triggers severe submission bottlenecks.

  • Inadequate Literature Justification: Relying on unverified literature or weak read-across data without robust scientific rationale invites immediate regulatory skepticism.

  • Inconsistent PEC Calculations: Utilizing varying market penetration factors and dilution assumptions across different EU member states compromises the scientific credibility of the application.

  • Siloed Teams: Failing to integrate data between CMC and Environmental, Health, and Safety (EHS) workstreams frequently results in duplicated testing efforts and conflicting documentation.

How Zenovel Supports Your European ERA Strategy

Navigating the nuances of the EMA’s phased ERA framework requires proactive planning and seamless integration across multidisciplinary teams.

At Zenovel, our regulatory and scientific experts help pharmaceutical sponsors bridge the gap between drug development and environmental compliance:

  • Early Phase I Screening & Gap Analysis: Conducting proactive screenings during late-stage clinical development to determine Phase II testing requirements well ahead of submission deadlines.

  • CRO Coordination & Study Design: Designing and managing Phase II Tier A and Tier B fate and ecotoxicology studies tailored to your regulatory timelines.

  • Scientific Justifications & Read-Across Assessments: Compiling defensible literature evaluations and structural read-across data to satisfy agency inquiries prior to commissioning new tests.

  • Multi-Market PEC Harmonization & Dossier Integration: Ensuring uniform, scientifically sound exposure calculations across all EU jurisdictions and authoring robust ERA modules that meet rigorous EMA expectations.
